1. Acceptance of Terms

By using this Site or entering into a service agreement with us, you confirm that you are at least 18 years old and have the legal authority to enter into a binding agreement. If you are entering these Terms on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Coral Gables Epoxy Flooring & Concrete Polishing provides concrete flooring installation, coating, resurfacing, and related surface preparation services for residential and commercial properties. Our services include, but are not limited to, epoxy floor coatings, polished concrete, garage floor coatings, pool deck resurfacing, and concrete grinding.

All services are subject to a separate written service agreement or estimate accepted by the client prior to work commencing. The Site is provided for informational purposes and to facilitate contact with potential customers - it does not constitute a service contract.

3. Estimates and Pricing

All pricing is provided through written estimates prepared after an on-site assessment of your project. Estimates are based on the conditions observed at the time of assessment and the scope of work described. Prices are subject to change if the scope of work changes, additional surface preparation is required beyond what was anticipated, or unforeseen site conditions are discovered once work begins.

We will communicate any changes to the estimated price in writing before additional work is performed. You are not obligated to accept any change in scope and may request that we limit work to the original agreed scope.

4. Scheduling and Cancellation

Projects are scheduled based on mutual availability after a written estimate is accepted. We reserve the right to reschedule work due to weather conditions, equipment issues, or circumstances outside our control. We will provide reasonable advance notice of any rescheduling.

If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Cancellations within 48 hours of a scheduled project start date may result in a rescheduling fee to cover mobilization costs already incurred. Any deposits paid may be non-refundable if cancellation occurs after materials have been ordered for your specific job. Specific cancellation terms will be stated in your written service agreement.

5. Payment Terms

Payment terms are specified in your written service agreement or estimate. In general, a deposit may be required to confirm scheduling and cover material costs. The remaining balance is due upon project completion and client walkthrough, unless otherwise stated in writing.

Accepted payment methods will be communicated at the time of estimate. Late payments may be subject to a finance charge. If payment is not received within the agreed timeframe, we reserve the right to pursue collection through available legal means and to recover reasonable attorney fees and costs incurred in doing so.

6. Client Responsibilities

To allow us to complete work properly, you agree to:

• Clear the work area of all personal property, furniture, vehicles, and stored items before the scheduled project start date
• Provide safe and reasonable access to the work area during scheduled work hours
• Disclose any known conditions of the property that may affect the work, including existing coatings, prior repairs, drainage issues, or pest activity
• Keep pets and unsupervised children out of the work area during installation and curing

Failure to meet these responsibilities may result in delays, additional costs, or reduced warranty coverage for the completed work.

7. Warranty Disclaimers

Any warranty for services performed will be stated in your written service agreement. Unless expressly stated otherwise in writing, we do not warrant that completed work will be free from defects caused by:

• Moisture vapor transmission through the concrete slab exceeding levels disclosed prior to work
• Structural movement or settling of the underlying slab
• Chemical spills, heavy impact, or abuse beyond normal use
• Modifications to the floor made by parties other than us after project completion
• Conditions that were not detectable during our pre-installation assessment

The Site and its content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Coral Gables Epoxy Flooring & Concrete Polishing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to lost profits, loss of data, or property damage not directly caused by our negligence.

Our total liability for any claim arising from services performed shall not exceed the total amount paid by you for the specific project giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

9. Intellectual Property

All content on the Site, including text, images, logos, and graphics, is the property of Coral Gables Epoxy Flooring & Concrete Polishing or its content providers and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

10. Dispute Resolution

In the event of a dispute arising from these Terms or any service we provide, we encourage you to contact us first at estimates@coralgablesepoxyflooringandconcretepolishing.com so that we can attempt to resolve the matter informally.

If informal resolution is not possible, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, unless both parties agree otherwise in writing. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or prevent irreparable harm.

11. Governing Law

These Terms and any service agreements entered into with Coral Gables Epoxy Flooring & Concrete Polishing are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the appropriate courts of Florida.

12. Modifications to These Terms

We may update these Terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically. For active service projects, the Terms in effect at the time your service agreement was signed will govern that project.
